    Whats my Play?

    Just got back from MGM Springfield. Ordered a salmon and veggies plate when I got there with some poker comps, and found this sharp piece of metal wire in my food. Even put it in my mouth but quickly noticed it cause it was big. Show it to the manager, they take it to the back and come back and offer me my comp back plus $15. Im like yeah ok whatever I'm gonna take that wire back, guy says sorry I cant do that and literally pulls it away from me as I try to grab it for him. I filed a complaint with guest services and they offered me another lol $15 comp. Anyway, do I have any grounds for a lawsuit here? I have pics and audio of them offering me compensation and refusing to return the object. I probably should have cut my mouth with it intentionally, but I didn't pull the trigger. Considering I didnt hurt myself, and they now have the evidence, Im assuming im SOL. Any lawyers have any thoughts on this?

    I don't know what your next move should be regarding compensation but I would not want
    that piece of metal identified. It looks like it fell out of someone or something.

    Looks like something that secured a bag of prepared food that someone carelessly squeezed into the pan or bowl. Not very relevant though - you almost ate some trash that easily could have hurt you.

    Send them a link to this thread after Druff promises to add to to radios next agenda.

    Tell them you want a check for $699 to go away. (i think that's the magic number)

    You might already be fucked though bc of the $15 comp you accepted.

    My first thought to myself when i saw that pic was, " i wonder what the entree was...was it seafood? I bet it was seafood"

    Then i actually read the paragraph.

    Im not giving any pro advice because frankly i really dont have a clue; That was just a gut instinct i had. Do you know what that beaded part is? Is that lead? Because that was my first thought is that is was some type of a leaded wire (like a messed up piece of fishing equipment or something)

    As far as the legal play, i dont really know but my opinion is that you are SOL - those fuckers knew damn well what they would be getting themselves into if you were able to keep that object. We need attorneys to chime in.

    And LOL at them offering you a measly $30. Fuck that shit

    did you cut your mouth, get infected, or get feverish?

    and can you prove your suffering was caused by the wire?

    Also, if you want to nail down what the hell that object really is, my best suggestion is to post it on Reddit.

    The sub to do this at is r/whatisthisthing. I periodically browse it and noticed over time that there are a lot of intelligent people all over the world who chime in to solve the identity of some pretty obscure /mysterious objects.

    I ANAL, but I think itís pretty tough to get real compensation if nothing actually happened. If something actually happened, like you getting cut, infected, dying, etc. then thatís huge. But since nothing happened, seems like the furthest itíll get is the restaurant getting fined or in trouble somehow.

    Before we go further, you need to figure out what your goal is. Are you looking to get hundreds or thousands of dollars of compensation here? Or are you just looking for something substantially better than lol $15 plus a comp refund.

    When I have that answer, I can guide you better.

    In the meantime, I'll give you my opinion of the whole thing.

    First off, a large, sharp metal object which ended up in your mouth is FAR worse than finding a hair in the food, or catching the object before it got to your mouth. Had it just been a situation of, "Oh crap, look what's in my salmon!", then a meal discount is all that's warranted.

    However, you had two circumstances which made it FAR worse:

    1) You did end up with the object in your mouth.

    2) The manager confiscated the object without your permission, and refused to give it back to you, in what clearly looks like an attempt to cover his ass (or the ass of one of his employees!)

    So you definitely have a right to be pissed, and a refund of the comp plus $15 is almost entering insult-to-injury territory.

    I have two big issues here. Namely, #1 this was extreme negligence to allow an object of that size to make it into your food, and #2 (more importantly), the manager should not be physically swiping the evidence of what occurred and refusing to let you have it.

    I think the niggardly compensation you got was the manager's way of keeping this story away from his bosses. Returning the comp makes your meal untraceable, and the $15 is so negligible that it would never be questioned. On the flip side, had he offered you $200 for this whole thing, he would have had to justify to the higher-ups why $200 was missing from the register!

    Regardless of which path you choose from this point, I would suggest you call the property, and find out from the operator the name, phone number, and working hours of the Food and Beverage Manager. That person tends to be the boss of all restaurants at casino properties (though some restaurants are individually owned). You should also find out if the restaurant is owned by MGM Springfield, or if it's owned by a third party. If it's MGM Springfield's, you have more power in the situation.

    Speak directly on the phone to the Food and Beverage Manager. Be polite and act "shocked" regarding the way all of this went down. Don't over-complicate the story, or he will tune you out. Repeatedly state that the two things that bother you are the carelessness of the cooks AND the manager's terrible attitude, where he physically grabbed the wire and actually held it away from you, like he was covering something up. It would help to state that your mouth is still sore, and that you're also concerned about tetanus, and now have to run off and get a shot for that (you probably should, actually). Also state that you were insulted by the $15 "settlement" they offered, as it felt like the manager was mocking you. Throw in a line like, "It felt like the equivalent of him offering me a penny." Also say something like, "I'm not trying to get rich off this. I was just hoping for something fair after what happened to me."

    Do NOT mention anything about lawyers or lawsuits.

    Let him throw out a number regarding what they'll give you. If you're planning upon eating at MGM Springfield again (even not that restaurant), maybe a large food credit which doesn't expire would be okay.

    If you're looking for something above $200, you're probably going to have to make an insurance claim against them, and that could go various ways. But I won't get into that until I hear your goals here.

    Regarding compensation, here's a similar-but-less-serious situation which occurred to me at Harvey's Lake Tahoe two years ago: https://vegascasinotalk.com/forum/sh...-wanted-answer

    Cliffs of the story are that a young, inexperienced manager didn't know the answer to an important pricing question (whether my Rewards Credits would be debited at 1:1 or 2:1), and then basically told me that it was up to me to take the chance and see what happens. When I wasn't happy with that answer and kept pressing to find out, she flipped out and yelled at me in front of the entire restaurant, making it seem as if I was the one at fault. I ended up leaving and not eating there.

    Later, after I complainted to the Food and Beverage Manager, he investigated the matter and determined that she committed about 5 different violations of restaurant policy by how she handled the situation. One of these violations included her attempt to cover it up afterwards and not voluntarily inform him that she had an altercation with a guest (which was required).

    Why is this similar to yours, given that you had a metal wire in your mouth, and I didn't eat there at all?

    Because both involved managers behaving badly, mistreating the customer, and presumably attempting to cover up the situation.

    What did I get?

    I got $100 food and beverage credit for any restaurant on property, which I was happy with.

    You deserve more than $100 because yours was far worse than mine. You had the DUAL ISSUE of a metal object in your mouth AND a manager who mistreated you and tried to cover things up.

    However, in order to avoid the hassle of dealing with insurance, I would be shooting for a $250 food credit here, and calling it a day. But it's obviously up to you.

    Don't worry about the, "You have no proof of injury" naysayers in this thread. You have proof of the existence of the object, and I doubt they will deny that it was there, once the F&B Manager confronts them. Proof of injury is only needed when you get lawyers or lawsuits involved. Here you're just looking for a goodwill credit to make this go away.

    Thanks, Druff. Im probably gonna end up taking your advice. I do have an ex-wife whos one of those litigous people who will sue anyone for anything (she just won a 65k lawsuit from a local hospital for denying her an internship cause she told them she was enrolled in the state medical marijuana program) and she contacted her lawyer who apparently said even though I wasnt injured I might have a case. Shes one of those lawyers who only gets paid if you win so it cant hurt to at least ask, but my expectations arent high.

    The thing that ticked me off a little is they kept asking me my tier level, like it was obv that I would have been better compensated if I wasnt some 1/2 low limit donk that logs 10 hrs a week at the tables. Also I think Druff is right that they def didnt want the manager to find out, but I dont want to call them and accept 250 if I really can maybe get a few G's out of them.

    Wife went there 2 weekends ago with her girlfriends.

    She said MGM being new & clean meant Foxwoods was dead to her now. But they ended up going off site to eat cause nothing was there.

    I’d rather regrout my bathroom tile.

    What interests me a little is Twin River. Just interesting how that little joint has grown and changed. New sports book & hotel. Good for them.

    My brother in law got a piece of string within a loaf of bread from Whole Foods, which he almost swallowed and had to pull out of his throat.

    They started out in the $25 credit range, and he kept fighting them, refusing to settle, until he got a check for $500.

    Above that amount had to be settled by the insurance company.

    Fuck a food credit at a place that would serve you that thing.

    I went to a Danny Meyer owned restaurant(niggas in the know, know who Im talking about, shout out sonatine) and an entire 6 person meal including drinks was comped caused my coworker chewed a piece of plastic glove that apparently was in a biscuit. First the apps were comped then the GM came over and comped everything. Apparently when it was tossed in the batter if might had tore off or something.

    Total of the meal was close to $300. We still tipped though
    It is in my bones which sucks so can make it hard to move sometimes. Trying to spend as much time with friends and family.

    Not sure how MGM works, but Caesars hands it to their insurance for any settlement in the 3-figure or higher range.

    When my car got damaged in 2009 in the Rio parking lot by their own workers (negligence, not malicious), I had to go through their insurance.

    $750 was the magic number. Up to that they pay out pretty easily. Beyond that, prepare for a fight. I accepted the $750.

    Here you go. You were not injured in any way. Your “case” (lol) has only nuisance value. If you want to run around to playing “victim” to get a $50 comp, go right ahead. A better idea is to just move on with your life. I know a guy who gets worked up about petty shit like this all the time. Recently, he has been suffering health problems of undetermined of origin. Don’t let the same thing happen to you.

    Update: got a call from a customer service rep at MGM today who offered me $90 in food comps and $50 in free slot play in exchange for signing an agreement saying I won't sue them in the future. Unfortunately, Im basically the anti-druff (Im the guy who never sends food back cause I dont want them to spit in it) so obv instead of negotiating I just snap accepted the deal.
